1. Introduction

These Terms and Conditions govern the Vocalist Golden Mic Competition (“Competition”) hosted by Vocalist Magazine (“Vocalist,” “we,” “us,” or “our”). By entering the Competition, participants agree to be bound by these Terms and Conditions. Please read them carefully before submitting your entry.

2. Eligibility

2.1. The Competition is open to individuals of any age at the time of entry.
2.2. Participants must be legal residents of South Africa.
2.3. Employees, contractors, or affiliates of Vocalist Magazine, its parent company, subsidiaries, or promotional partners, as well as their immediate family members (spouse, parents, siblings, and children) and household members, are not eligible to participate.
2.4. Participants must have the legal right to record and perform music. If the participant is not bound by any exclusive contracts that would prevent them from fulfilling the obligations of the prize, Vocalist Magazine may make the song “Break The Chains” available to the winner for recording and performance, reserving 30% of income generated from the song.
2.5. Vocalist Magazine reserves the right to offer the winner an exclusive contract to act as their agent, producer, and publisher, provided the winner is not already signed to an exclusive contract with another party.

3. Competition Period

3.1. The Competition begins on July 5, 2025, at 12:00 AM South African Standard Time (SAST) and ends on September 15, 2025, at 11:59 PM SAST (“Competition Period”).
3.2. Entries submitted before or after the Competition Period will not be considered.

4. How to Enter

4.1. To enter, participants must record a video performance of themselves singing the official “Break The Chains” song clip provided on the BizzBuddy TikTok profile (@bizz.buddy) and post the publicly accessible video on TikTok, Instagram, or Facebook. Participants must tag the following official Vocalist Magazine social media accounts in their post: TikTok (@bizz.buddy), Instagram (@bizzbuddy.sa), and Facebook (BizzBuddySA). Participants must also like and follow these accounts on TikTok, Instagram, and Facebook.
4.2. Participants must email their full name, contact information, a brief biography (up to 500 words), photo’s (preferably professional) and a link to their social media post to admin@vocalist.co.za.
4.3. Only one entry per participant is permitted. Multiple entries will result in disqualification.
4.4. Submissions must not contain offensive, defamatory, or inappropriate content, as determined by Vocalist Magazine in its sole discretion.
4.5. There is no fee to enter the Competition.

5. Prize

5.1. The winner will receive the following prize package:

  • Rights to “Break The Chains”: The winner will be granted a non-exclusive license to record and perform the full version of the original song “Break The Chains” provided by Vocalist Magazine, subject to Vocalist Magazine reserving 30% of income generated from the song. The winner is responsible for any recording or production costs.
  • Promotion by Vocalist: Vocalist Magazine will promote the winner’s recorded version of “Break The Chains” across its platforms, including but not limited to its website, social media channels (TikTok: @bizz.buddy, Instagram: @bizzbuddy.sa, Facebook: BizzBuddySA), and email newsletters.
  • Feature in Vocalist Magazine: The winner will be announced in the October 2025 issue of Vocalist Magazine and will receive an exclusive interview feature to share their journey and talent.
    5.2. The prize is non-transferable, non-exchangeable, and has no cash equivalent.
    5.3. Vocalist Magazine reserves the right to substitute any portion of the prize with an alternative of equal or greater value if circumstances beyond its control make it necessary.

6. Judging and Winner Selection

6.1. Entries will be judged by a panel of music industry professionals selected by Vocalist Magazine based on the following criteria: vocal ability (30%), performance quality (25%), originality/creativity (25%), and engagement with Vocalist Magazine’s social media pages (20%). Engagement includes liking, following, and sharing Vocalist Magazine’s social media accounts (TikTok: @bizz.buddy, Instagram: @bizzbuddy.sa, Facebook: BizzBuddySA) and promoting the “Break The Chains” song clip, in accordance with the guidelines outlined in our article at https://vocalist.co.za/?p=3476, to demonstrate support for the Competition and its community.
6.2. The judges’ decisions are final and binding in all matters related to the Competition.
6.3. The winner will be notified by email and/or phone within 7 days of the Competition’s closing date (by September 22, 2025).
6.4. If the winner cannot be contacted or does not respond within 7 days of notification, Vocalist Magazine reserves the right to select an alternate winner.

7. Intellectual Property

7.1. By submitting an entry, participants grant Vocalist Magazine a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, and display their submission (including photo’s, video, audio, and biography) for promotional purposes related to the Competition.
7.2. Participants represent and warrant that their submissions are original or that they have the necessary rights to submit the content and grant the license described above.
7.3. The song “Break The Chains” (both the song clip and full version) remains the intellectual property of Vocalist Magazine or its designated rights holder. The winner will receive a non-exclusive license to record and perform the full song, subject to Vocalist Magazine reserving 30% of income generated from the song as outlined in section 2.4, but will not own the underlying composition or lyrics.

8. Publicity

8.1. By entering, participants agree to allow Vocalist Magazine to use their name, photo’s, likeness, biography, and submission materials for promotional purposes, including but not limited to announcements, interviews, and marketing materials, without additional compensation.
8.2. The winner agrees to participate in the exclusive interview for the October 2025 issue of Vocalist Magazine and any reasonable promotional activities requested by Vocalist Magazine.

9. Limitation of Liability

9.1. Vocalist Magazine is not responsible for:

  • Lost, late, incomplete, invalid, or misdirected entries.
  • Technical failures, including but not limited to email delivery issues, network disruptions, or equipment malfunctions.
  • Any injury, loss, or damage arising from participation in the Competition or use of the prize.
    9.2. Vocalist Magazine reserves the right to cancel, suspend, or modify the Competition if fraud, technical failures, or any other factor beyond its control impairs the integrity of the Competition.

10. Privacy

10.1. Personal information provided by participants will be used solely for the purposes of administering the Competition and delivering the prize, in accordance with Vocalist Magazine’s Privacy Policy.
10.2. Participants’ personal information will not be shared with third parties except as necessary to administer the Competition or as required by law.

11. General Conditions

11.1. Vocalist Magazine reserves the right to disqualify any participant who violates these Terms and Conditions or engages in conduct deemed harmful to the Competition’s integrity.
11.2. The Competition is subject to all applicable South African laws and regulations.
11.3. These Terms and Conditions are governed by the laws of South Africa. Any disputes arising from the Competition will be resolved in the courts of Klerksdorp, South Africa.
